How to Get a Marriage License in Tyler (Smith County, TX)

Getting a marriage license in Tyler starts at the Smith County clerk. Learn who must apply, the fee range, the 72-hour wait, and how long your license lasts.

If you searched for a Tyler marriage license, here is what to know before you go. Tyler is the county seat of Smith County, and the office you need is the county clerk.

Who issues the license

Marriage licenses in Texas are issued by county clerks, not by cities. Tyler does not issue its own license. You apply through a county clerk's office.

You do not have to live in Smith County to apply there, and you do not have to live in Texas. A license from any Texas county clerk is valid statewide. If you are getting married somewhere else in Texas, you can still apply in Tyler, and a license issued elsewhere in Texas works for a ceremony in Tyler.

What to expect when you apply

Both of you normally need to appear in person, and each of you should bring valid photo ID. If either of you can't make it, call the clerk before you plan the trip.

The county clerk sets many of the practical details, and we don't have reliable information on them for this office. Before you go, confirm these directly with the Smith County Clerk:

•The office's address and which location handles marriage licenses

•Opening hours

•Whether you need an appointment or can walk in

•Which payment methods are accepted

•The exact fee

•Any extra documents the office wants beyond photo ID

A short call or a look at the county's official website will settle all of this. It is much better than finding out at the counter.

What it costs

Each county sets its own fee, and it is typically about $70 to $85. Ask the clerk for the exact amount and which payment methods they take.

There is one way to lower the cost. A Twogether in Texas premarital education certificate removes up to $60 of the fee. If you plan to take the course, finish it and get your certificate before you visit the clerk, and bring the certificate with you.

The 72-hour waiting period

Texas requires 72 hours between the day the license is issued and the ceremony. If you pick up your license on a Monday afternoon, you can't marry until the same time on Thursday.

Three situations remove the wait:

•Either of you is active-duty military

•You have a judge's written waiver

•You have a Twogether in Texas premarital course certificate

If you fall into none of these, count the days backward from your ceremony and apply with room to spare. The wait is the part that catches most couples off guard.

How long the license lasts

Your license is valid for 90 days from the date it is issued. After that it expires, and you would need to apply again and pay the fee again.

That window works in your favor. You can apply well before the wedding, clear the 72-hour wait early, and not worry about it in the final week. Just don't apply so early that the 90 days run out before your ceremony.

A simple plan for most couples:

1.Pick your ceremony date.

2.Decide whether you will take the Twogether in Texas course. If you will, finish it first.

3.Call the Smith County Clerk to confirm location, hours, appointment rules, payment methods and the exact fee.

4.Go in together with valid photo ID, and bring your course certificate if you have one.

5.Check that your ceremony falls after the waiting period and within the 90 days.

That covers the whole process: one office, both of you in person, a fee set by the county, a 72-hour wait unless you qualify to skip it, and 90 days to use the license.
