How to Get a Marriage License in San Patricio County, TX: Courthouse Guide

How to get a marriage license in San Patricio County, Texas: who applies, what to bring, the 72-hour wait, how long it lasts, what to confirm with the clerk.

Who issues the license

In Texas, marriage licenses come from the county clerk, not from a city office. If you are marrying in San Patricio County, the office you are looking for is the county clerk. A city hall or a courthouse annex will not issue it for you.

You do not have to use the San Patricio County clerk, though. A Texas marriage license is valid statewide, and there is no residency requirement. You can apply with any county clerk in Texas and use the license anywhere in the state. If you live elsewhere but want to marry in San Patricio County, you can still apply with the clerk that is most convenient for you.

What you both need to do

Both of you normally need to appear in person at the clerk's office, and each of you needs valid photo ID. Plan the visit for a day when you can both be there. If one of you cannot make it, ask the clerk before you go whether anything can be done. Do not assume it can.

What it costs

Each county sets its own fee, and it is typically about $70 to $85. We do not know the exact fee in San Patricio County, so confirm it with the clerk before you go.

There is a way to lower the cost. A Twogether in Texas premarital education certificate removes up to $60 of the fee. If you are willing to take the course first, bring the certificate with you when you apply.

The 72-hour wait and how long the license lasts

Texas requires a 72-hour wait between the day the license is issued and your ceremony. You cannot get a license on Friday and marry that same afternoon, so work this into your calendar.

The wait is waived in three situations:

•Either of you is on active-duty military.

•You have a judge's written waiver.

•You have a Twogether in Texas premarital course certificate.

Once issued, the license is valid for 90 days from the date of issuance. Your ceremony needs to happen inside that window. If you are planning a wedding months out, count forward from the day you pick up the license, not the day you set the wedding date. Applying too early could leave you with an expired license.

Confirm these details before you go

The specifics of the San Patricio County clerk's office are not something we can give you. Before you make the trip, contact the clerk directly and ask:

•Where the office is and what its hours are.

•Whether you need an appointment or can walk in.

•What the exact fee is.

•Which forms of payment are accepted.

•Whether you need to bring anything beyond your valid photo IDs.

•How the office handles a Twogether in Texas certificate or a judge's waiver, if either applies to you.

Write the answers down so you both have them. Offices can change their hours and policies, so check close to the day you plan to go rather than relying on something you heard months ago.

A simple order of steps

1.Decide whether you will take the Twogether in Texas course. It lowers the fee and removes the 72-hour wait, so it is worth deciding before you apply.

2.Choose your ceremony date, and make sure it falls within 90 days of when you expect to get the license.

3.Contact the county clerk to confirm the address, hours, appointment rules, fee and payment methods.

4.Go together with your valid photo IDs, and your certificate or waiver if you have one.

5.Mark the issuance date, add 72 hours if no waiver applies, and mark the date 90 days out.

With those dates written down, you will know when you can marry and when the license expires.
